The Mediation Centre helps families, couples, workplaces and businesses resolve disputes. To do that, we need to hold some personal information about the people we work with. This policy explains what we collect, why, how we protect it, and the rights you have under the General Data Protection Regulation (GDPR) and the Data Protection Acts 1988 to 2018.
The Mediation Centre is operated by Kieran Hickey as a sole trader. For the purposes of data protection law, Kieran Hickey trading as The Mediation Centre is the data controller for the personal information described in this policy.
Depending on how you deal with us, we may hold:
Mediation sometimes involves sensitive information, for example about health, wellbeing or family relationships. We only hold this where it is relevant to your mediation and where you have chosen to share it with us, and we take extra care to protect it.
| Purpose | Legal basis |
|---|---|
| Responding to your enquiry and arranging an initial call | Steps taken at your request before entering a contract, and our legitimate interest in responding to enquiries |
| Providing mediation services, preparing documents and drafting agreements | Performance of our contract with you (Agreement to Mediate) |
| Handling sensitive information you share for your mediation | Your explicit consent, and where relevant the establishment, exercise or defence of legal claims |
| Invoicing, accounts and tax records | Legal obligation |
| Meeting our professional, regulatory and insurance requirements | Legal obligation and our legitimate interests |
| Keeping our systems and records secure | Our legitimate interests |
You can withdraw consent at any time by contacting us. This does not affect anything we did before you withdrew it, but it may mean we cannot continue with the mediation.
Mediation is a confidential process under the Mediation Act 2017 and the terms of your Agreement to Mediate. What is said in mediation is not shared outside the process except:
Information you share in a private session is not passed to the other party without your permission.
We never sell your personal information. We only share it where necessary, with:
Some of our service providers may process data outside the European Economic Area. Where this happens, we rely on recognised safeguards such as the European Commission's Standard Contractual Clauses or the EU US Data Privacy Framework, so your information receives the same level of protection.
| Information | How long |
|---|---|
| Case files, signed agreements and session notes | 6 years after your case closes |
| Financial and payment records | 6 years after the end of the tax year they relate to |
| Enquiries that do not go ahead | 12 months from last contact |
After these periods we securely delete or destroy the information, unless we need to keep it longer because of an ongoing legal matter.
You have the right to:
To use any of these rights, email info@themediationcentre.ie. We will respond within one month. There is normally no charge. We may need to confirm your identity first.
Because mediation involves more than one person, we may need to withhold or redact information that relates to another party, or that was shared with us in confidence, in order to protect their rights.
